The Scamers are still going strongI talked to a fellow today who had followed the advice of a fellow named Joe Saladino of something called
the Freedom and Privacy Committee. The poor guy, using the advice of the conman, had filed criminal complaints
against the judge in a summons case. He had not properly raised the Fifth Amendment. The judge had fined him over
$100,000 in fines for his position and he had waived his Fifth Amendment Rights. It is very sad that conmen like this
Saladino fellow are running around victimizing individuals who do not have adequately developed baloney detectors. Please
be careful. Remember that if it sounds too good to be true, it probably is too good to be true.

The Military Commissions Act“…the key
question is: can we define ‘income’ in a fair and reasonably straightforward manner? Unfortunately
we have not yet succeeded in doing so” –Shirley Peterson, former IRS Commissioner, April 1993
Recently, the House and Senate approved the Military Commissions Act. This is a radical change in
government. Our protections involving conditions of detention, speedy trial, humane treatment, indefinite
detention, or protection by international law may, as a result, also be changed radically. The checks and
balances that keep the executive balanced in power with the judicial and executive have been radically changed.
We have long been the country with the best standard in terms of human rights. If other countries
follow our path, human rights around the world will take a supreme nose-dive.
The MCA is a severe problem in terms of its denial of habeas corpus. This right is a cornerstone
of our justice system. If an individual is wrongly imprisoned, how is he going to argue that fact if he
is not allowed habeas corpus? And what is an “enemy combatant.” Could the
IRS say that anyone involved in protesting the abusive procedures of the IRS is an “enemy combatant?”
This new law gives the president unprecedented power to determine the use of coercive torture techniques in interrogations
and gives all US officials retroactive blanket immunity from charges brought against them. Could the IRS
use water-boarding to get you to confess to tax crimes? Well it now “requires” you to give
it voluntary information under the threat of incarceration.
When I got involved in this movement over thirty years ago, I thought we had a severe problem, but I had no idea the
extent of the problem and I never thought it would be worse in thirty years. Yet, we are here, a new age,
the young tax advocates of my generation are now the old advocates ready to pass the banner soon
to the next generation.
The strongest argument we have had over the last thirty years, the argument that gives the IRS the most trouble is
the Fifth Amendment. Yet the IRS is doing everything it can to make this argument go away.
The administration continues to pass laws aimed at destroying not only our rights but our position in the middle class.
The situation in this country is similar to pre-WW2 Germany. It wouldn’t take much for the
misery level to increase to a point where there are mass demonstrations and then under the new laws, there may be mass incarceration
and torture with no habeas corpus.
Please pay attention as the government attempts to usurp more power, the income tax is a huge problem, but it is not
our only problem. Hang in there and learn to fight smart against tyranny!

Spring Roundup is here for the IRSIt is spring time again
and the IRS has started its Spring Roundup. That means you are going to hear more about criminal cases.
Yes, the IRS does prosecute some individuals each year for willful failure to file tax returns. If
you review my site, you will see that the IRS consistently refers to the tax system as “voluntary.”
You will also see that the 10th Circuit Court of Appeals took the position that the Fifth Amendment does
not apply to tax returns because it only applies to compelled testimony. In other words, filing tax returns
is voluntary. There is no doubt about it. This means, that in order to continue the illusion that filing is required, the IRS
must convict a few key people each year of willful failure to file returns so that the general public believes that filing
returns is required. During spring roundup, the IRS indicts a few people around the country and gives them
free room and board and pays their health insurance because they didn’t volunteer. The IRS especially
likes to indict vocal critics who are respected professionals. The agency gets the most fear value for
its money with this approach. Dentists, Chiropractors, Doctors, Mortgage Bankers and airplane pilots are
at the top of their list. Juries
convict the IRS’ victims because they don’t understand the real issue. The jury convicts the
defendant because they think the defendant will get away without paying taxes if he isn’t convicted. They
don’t understand they must get inside the mind of the defendant and assure themselves that the defendant believed he
was required to file a return but failed to do so. Yes, tax crimes involve the issue of “willfulness.”
Individuals are not guilty of not filing a return simply because they don’t file, they are guilty if they believe
they are required to file and they don’t file. After the criminal trial, even if the defendant is determined to be innocent
of “willful failure” to file, the IRS will seize his assets and destroy him financially In the thirty-one years that I have been involved
in the Freedom Movement, I have watched many innocent people go to prison. Years ago I was involved as
a paralegal in a criminal trial in which the government had indicted a parking-lot attendant, who owed less than $500 dollars,
for tax evasion. This poor lady made about $6,000 a year and she had two children. She
was victimized by the IRS because she filed an exempt W-4 Form and bragged about it. The legal team appealed
her case to the Supreme Court and she lost. She went to prison for six months and left her children.
The Feds had to come up with welfare for her family and her children became wards of the state. That is a true story
of your government in action and I hope you get mad reading this. The moral of the story is that there a lot of conmen who are roaming the web.
I have listed a few of them in my frauds and scams page. If you find a website that advises you
to file an exempt or inflated W-4 Form do not follow the advice. In other words, do not file an exempt
or inflated W-4 Form. Also do not file any of the other forms that you can download for free on these magical
tax elimination websites. The government can garnish your wages. The state governments
can be even more difficult to deal with now that the Imperial President has destroyed bankruptcy for the middle-class.
Both the federal and state tax agencies have become emboldened by the fact that the middle class is no longer effectively
protected by the bankruptcy laws.
So hang in there and learn to fight back smart.

Our Hero, Ed BrownHello fellow Americans.
Have you seen all the publicity on the web about Ed Brown in New Hampshire. Now, he is a real hero!
He was convicted of a tax crime, but tax crimes involve “willfulness”.
In other words, it is not a
crime not to file a tax return. It is a crime if you think that you are required to file a return and you
don’t file it. The congress put the “willfulness” requirement in tax crime statutes because
the rules are so complicated that anyone could be convicted of anything. Now if there is one thing that
is true, it is true that Ed Brown believes his position. He could not possibly be guilty of the crime he
was convicted because he is obviously not “willful.” However the juries don’t understand
this issue. Juries think that if they don’t convict a tax defendant that the guy won’t have
to pay taxes. The truth is that even if the defendant wins the case, the IRS still comes after him civilly
and strips him of his worldly wealth. Congress has given the IRS incredible draconian power so that the
Imperial President can run the huge military industrial complex all over the world. If anybody out there
knows this fellow’s address, please let me know. I would like to send him a signed first edition
of my book: Why No One is Required to File Tax Returns.

The State of the NationThe American Economy is in real trouble.
Thirty years ago, I didn’t think that we would make it to the year 2000 without a financial collapse.
We are still here but things are getting much worse. Kids in their twenties are getting out of school
with huge college loans and they can’t get good paying jobs. A college diploma is equivalent to a
high-school diploma of a generation ago. Even if the youth of today get a job, it may not last for very
long. They end up living on credit cards, and the Bush Administration just wiped out bankruptcy.
Millions of them have no health insurance, and a sickness or injury will mean financial disaster. Meanwhile jobs are
continually leaving the country. As you know general motors cut over 30,000 jobs recently.
Just think of all the other jobs that will disappear related to those 30,000 jobs! Our deteriorating
economy is rapidly deindustrializing. Our debt is monstrous. The psychopaths and sociopaths
who run the American Government are in the process of destroying the country, ransacking the economy, and plundering our communities
for their own personal gain. The income tax is only a small symptom of the real problem. And
now the administration has once again turned the IRS’ power onto the middle class. Audits are up,
criminal prosecutions are up, seizures and levies are up. The middle class is the principal target.
You are sure to see things get much worse in the near future as our leaders lie to us to get us into greater debt in
their quest for ever increased global power. The
Bush administration has rewritten Justice Department rules so it can keep records indefinitely, even when they prove irrelevant
to an investigation. The government can also share the records broadly, enabling the FBI to build what
amounts to electronic dossiers on untold numbers of Americans. (My Fifth Amendment regarding the income tax is now more important
than ever.) For example, last summer, the FBI demanded records of everybody who
used a specific computer at a Connecticut library. The government can now use National Security Letters
to get names of whoever they want. If you rent a car, stay in a hotel or even buy groceries, your name
can end up on a list that is given to the FBI. It is up to us to safeguard the Bill of Rights;
I hope that we can meet the challenge.
